1. Who We Are

Kyon Capital LLC ("Kyon", "we", "us", "our") is a real estate finance advisory firm based in Florida. We help clients evaluate and compare financing options; we are not a mortgage lender and do not originate consumer mortgage loans.

Mortgage financing referenced on this site is originated by separately licensed mortgage loan originators through their licensed lending relationships. Marcos Medeiros is a licensed Mortgage Loan Originator, NMLS 2430313, originating through CrossCountry Mortgage, LLC, NMLS 3029.

2. Informational Only — Not an Offer

This website is for informational purposes only. Nothing here is an offer or commitment to lend, a guarantee of eligibility, approval, terms, or funding, or a recommendation of any specific product. All financing is subject to underwriting, valuation, title, insurance, documentation, and program guidelines.

3. No Professional Advice

Kyon provides educational information and financing guidance. We do not provide legal, tax, accounting, or investment advice. Consult your own attorney, tax advisor, or financial professional before acting on anything you read here.

4. Rates & Illustrations

Any rates, points, fees, or pricing concepts shown are illustrative and for educational purposes only. They are not an offer or commitment, do not reflect a specific quote, and are subject to change without notice. Actual pricing depends on the lender, the borrower's profile, the property, market conditions, and program guidelines.

5. Pre-Approval & Underwriting

A pre-approval is a preliminary assessment based on information provided and is not a commitment to lend, a loan approval, or a guarantee of financing. It is subject to verification, full underwriting, appraisal, title, insurance, satisfactory documentation, and program guidelines, and may change or be withdrawn. A pre-approval letter, if issued, is typically valid for 90 days from issuance and is issued by the lender, not by Kyon.

All financing is subject to underwriting review and approval. Terms are not final until issued by the lender in writing and may change prior to closing.

6. Timelines

Any timeframes described — for consultations, applications, underwriting, or closing — are general estimates only, vary by transaction, and are not guarantees. Actual timing depends on documentation, valuation, title, insurance, underwriting, third parties, and program guidelines.

7. Credit Inquiries

Where available and applicable, an initial review may use a soft credit inquiry, which does not affect your credit score. A hard credit inquiry, which may affect your score, may be required later as part of a formal application or underwriting; you will be informed beforehand. Your authorization is required before any credit is obtained.

8. Private Lending

Private lending products offered or arranged by Kyon are business-purpose, asset-based loans for real estate investors and are not consumer mortgage loans. They are not intended for the purchase of an owner-occupied primary residence. Borrowers may be required to certify the business purpose of the loan. These loans involve risk, including the risk of loss.

Real estate investing involves risk, including market, construction, timing, and liquidity risk and the potential loss of capital. The use of leverage can increase both potential returns and potential losses. Past performance does not guarantee future results.

9. Communications & Forms

By submitting a form or otherwise contacting us, you consent to be contacted by Kyon by email, phone, text, or messaging regarding your inquiry, using the contact details you provide; message and data rates may apply, and you may opt out at any time. Submitting a form does not create an application, lending relationship, or obligation.

10. Third-Party Lenders & Compensation

Kyon works with separately licensed mortgage loan originators and third-party lending sources. Mortgage financing is provided by those lenders, not by Kyon. There is no charge to you for Kyon's consultation or guidance. Where a transaction closes, the licensed originator is compensated through the lender's customary channels in accordance with applicable law; Kyon does not charge a separate advisory fee.

Kyon does not guarantee the products, pricing, decisions, or performance of any third-party lender.

11. Content & Intellectual Property

All content on this site — including text, graphics, logos, images, and layout — is owned by or licensed to Kyon Capital LLC and is protected by U.S. and international intellectual property laws. You may view and share content for personal, non-commercial use. You may not copy, reproduce, modify, republish, or use it for commercial purposes without our prior written permission.

12. Prohibited Uses

You agree not to use this site to:

  • violate any applicable law or regulation;
  • impersonate any person or misrepresent your relationship to any person or organization;
  • interfere with the operation of the site or attempt to gain unauthorized access to any systems or data;
  • upload viruses, malware, or other harmful code; or
  • scrape, harvest, or collect information about other users.

13. State & Service Availability

Kyon is based in Florida. Services are available across most U.S. states; availability of any particular product or originator depends on applicable licensing and is confirmed during your consultation. Products and services may not be available in all states.

14. Disclaimer of Warranties

This site and its content are provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, Kyon disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, error-free, or that information is current or accurate at any given moment.

15. Limitation of Liability

To the fullest extent permitted by law, Kyon Capital LLC and its members, officers, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of this site or any reliance on its content, even if advised of the possibility of such damages.

16. Languages

This site may be provided in English, Portuguese, and Spanish for convenience. If there is any inconsistency between language versions, the English version governs. Translated materials are for general information and may not reflect the most current updates; required disclosures and loan documents may be provided in English.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date above. Material changes will be reflected on the site; your continued use after changes are posted means you accept the updated Terms.

18. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
